LONDON (Reuters) – Britain published plans on Monday to override some of the post-Brexit trade rules for Northern Ireland by scrapping checks and challenging the role played by the European Union’s court in a new clash with Brussels.

Despite Ireland describing the move as a “new low” and Brussels talking of damaged trust, Britain pressed ahead with what Prime Minister Boris Johnson suggested were “relatively trivial” steps to improve trade and simplify bureaucracy.

Tensions have been simmering for months after Britain accused the bloc of taking a heavy-handed approach to the movement of goods between Britain and Northern Ireland – [checks needed to keep an open border](https://www.financedigest.com/uk-plans-streamlined-post-brexit-border-checks.html "UK plans streamlined post-Brexit border checks") with EU-member Ireland.

Always the toughest part of the Brexit deal, the situation in the region has sent alarm bells ringing in [European capitals](https://www.financedigest.com/collegiate-ac-and-shuman-capital-launch-e300-million-european-student-living-fund.html "Collegiate AC and Shuman Capital launch €300 million European Student Living Fund") and Washington, and among business leaders. It has also heightened political tensions, with pro-British communities [saying their place in the United](https://www.financedigest.com/offshore-crews-to-strike-on-bps-north-sea-installations-says-unite.html "Offshore crews to strike on BP’s North Sea installations, says Unite") Kingdom is being eroded.

I’m very willing to negotiate with the EU, but they do have to be willing to [change the terms of this agreement which are causing these very severe problems in Northern Ireland,” British Foreign Secretary Liz Truss](https://www.financedigest.com/seeking-right-tone-new-uk-pm-truss-had-to-quickly-change-gear-for-queen.html "Seeking right tone, new UK PM Truss had to quickly change gear for queen") said.

“We’re completely serious about this legislation.”

Britain has pointed to the breakdown of a power-sharing administration in [Northern Ireland](https://www.financedigest.com/biden-uks-truss-commit-to-protect-northern-ireland-deal.html "Biden, UK’s Truss commit to protect Northern Ireland deal") as a reason for drafting the legislation, the first step in what could be a months-long process before the bill becomes law.

The [legal advice](https://www.financedigest.com/some-credit-suisse-at1-bondholders-seek-legal-advice-law-firms.html "Some Credit Suisse AT1 bondholders seek legal advice -law firms") cited the “doctrine of necessity”, which is invoked when governments may take law-breaking action to protect stability, as the foundation for the move, saying the conditions had been met because of the situation in Northern Ireland.

Britain has long complained that negotiations with the EU have failed to [come to fruition and the legislation is seen as an insurance](https://www.financedigest.com/the-glorious-twelfth-what-underwriters-should-be-doing-as-the-insurance-act-comes-into-force.html "The Glorious Twelfth: What Underwriters Should Be Doing As the Insurance Act Comes Into Force") policy, and possibly a bargaining chip. The bill could accommodate any solution [agreed in those talks](https://www.financedigest.com/u-s-ukraine-agree-to-launch-talks-to-upgrade-2008-trade-accord.html "U.S., Ukraine agree to launch talks to upgrade 2008 trade accord").

But a new trade row with the EU comes at a time when Britain faces its toughest economic conditions in decades, with [inflation forecast to hit](https://www.financedigest.com/uks-december-shopper-numbers-defy-inflation-and-rail-strikes-hit.html "UK’s December shopper numbers defy inflation and rail strikes hit") 10% and growth stalling. Johnson said any [talk of a trade](https://www.financedigest.com/tax-credits-for-eu-electric-vehicles-to-dominate-mondays-trade-talks-with-u-s.html "Tax credits for EU electric vehicles to dominate Monday’s trade talks with U.S") war would be a “gross, gross overreaction.

NEW CLASH

Britain has long threatened to rip up the protocol, an agreement that kept the region under some EU [rules and drew an effective customs border](https://www.financedigest.com/slipping-over-mexico-border-migrants-get-the-jump-on-u-s-court-ruling.html "Slipping over Mexico border, migrants get the jump on U.S. court ruling") between Northern Ireland and the rest of the UK to prevent a back door for goods to enter the EU’s vast single market.

It is now planning a “green channel” for goods moving from Britain to Northern Ireland, to [change tax rules](https://www.financedigest.com/uk-watchdog-warns-crypto-firms-to-prepare-for-advertising-rule-change.html "UK watchdog warns crypto firms to prepare for advertising rule change") and end the European Court of Justice’s role as sole arbiter in disputes. It also wants a dual regulatory regime, angering companies which fear [higher costs](https://www.financedigest.com/uk-pub-operator-wetherspoons-loss-narrows-despite-higher-costs.html "UK pub operator Wetherspoon’s loss narrows despite higher costs").

The move has yet again exposed divisions in Johnson’s Conservative Party, a week after the [prime minister](https://www.financedigest.com/britains-queen-elizabeth-will-appoint-new-prime-minister-at-balmoral.html "Britain’s Queen Elizabeth will appoint new prime minister at Balmoral") just survived a rebellion by his own lawmakers.

Brexit-supporters said it could have gone further, critics [feared it again undermined London’s](https://www.financedigest.com/london-fears-losing-luxury-shoppers-to-paris-and-milan.html "London fears losing luxury shoppers to Paris and Milan") standing in the world by challenging an international agreement.

Similar splits were evident in [Northern Ireland](https://www.financedigest.com/exclusive-new-frontiers-collection-launch-to-capitalize-on-northern-ireland-housing-supply-shortfall.html "Exclusive new Frontiers’ Collection launch to capitalize on Northern Ireland housing supply shortfall").

Brussels believes any unilateral change may breach [international law](https://www.financedigest.com/international-law-firm-calls-in-viato-connect-uk-and-us-offices.html "INTERNATIONAL LAW FIRM CALLS IN VIATO CONNECT UK AND US OFFICES"). It could launch legal [action or eventually review the terms of the free trade deal it agreed with Britain](https://www.financedigest.com/britain-braces-for-winter-of-strike-action-as-nurses-walk-out.html "Britain braces for winter of strike action as nurses walk out"). It has already thrown [doubt on Britain’s role](https://www.financedigest.com/inflation-fighting-central-bankers-air-climate-role-doubts.html "Inflation fighting central bankers air climate role doubts") within the $99 billion Horizon Europe research programme.

U.S. House of Representatives Speaker Nancy Pelosi has also said there will be no U.S.-UK [trade deal](https://www.financedigest.com/lme-forced-to-halt-nickel-trading-cancel-deals-after-prices-top-100000.html "LME forced to halt nickel trading, cancel deals, after prices top 0,000") if London scraps the protocol. Truss said the United States appreciated the [importance of the peace deal](https://www.financedigest.com/eu-seeks-deal-on-law-preventing-import-of-deforestation-linked-goods.html "EU seeks deal on law preventing import of deforestation-linked goods"), and wanted the problem resolved.
